Libreville, Friday, June 9, 2023 (Gabon Info) – In a statement made yesterday, François Mangari, Secretary General of the Chancellery of the Ministry of Justice, Keeper of the Seals, listed the various advantages granted to the National Union of Magistrates of Gabon (SYNAMAG) whose members have observed a movement of mood since six months.

” Ladies and gentlemen,

On Thursday June 8, 2023, following the hearing by the National Assembly of the Minister of Justice, Keeper of the Seals, in charge of Human Rights and Gender Equality on the Bill on Statute of Magistrates, the National Syndicate of Magistrates of Gabon (SYNAMAG) made a declaration during which it decided to suspend the minimum service and called on all the magistrates of the jurisdictions of the interior of the country to join Libreville to a national consultation of the Judiciary.

The Syndicate justifies this position, which is serious to say the least, by the fact, according to it, that the draft presented to the National Assembly does not correspond to the preliminary draft drawn up in a consensual and contradictory manner between the services of the Ministry of Justice and the SYNAMAG.

The government wishes to recall that, since the Magistrates went on strike in December 2022, social dialogue has never been broken. On the contrary, the government has endeavored to find solutions to all the points of claim contained in the specifications submitted to it by SYNAMAG, as evidenced by:

  • The effective endowment of all the heads of jurisdictions with rolling stock;
  • The order and the actual payment of the hearing suits which will be delivered before the next judicial day;
  • The gradual regularization of administrative situations; And
  • The insertion in the legislative process of the bill on the Statute of magistrates.

With particular regard to the draft Statute for Magistrates, the government specifies that, contrary to SYNAMAG’s assertions, the text currently under consideration by the National Assembly corresponds broadly to the preliminary draft adopted by consensus with SYNAMAG. , apart from some adjustments and some improvements inserted with the aim of allowing an effective application of its various provisions.

Indeed, in accordance with the constitutional principle according to which each new expenditure charged to the State budget must, beforehand, be backed by a resource making it possible to support it, it was essential for the government to ensure that the advantages which magistrates could now benefit from can be effectively funded.

Furthermore, the government would like to point out that within the framework of the legislative process which has begun, SYNAMAG has the possibility of presenting its observations and remarks before the two Chambers of Parliament, which alone are competent to adopt the said bill in its version. final.

Because of these significant advances and the foregoing, the government considers that to date nothing justifies the maintenance of the current strike movement which is paralyzing the judicial system and causing significant harm to all the populations living in the territory. national level and, above all, to the Gabonese people as a whole, in whose name Justice is rendered.

Finally, the Government would like to point out that, in accordance with the provisions of the texts in force, the maintenance of a minimum service during strike periods is an obligation which no one can escape.

Also, the Government appeals to the responsibility of SYNAMAG and all the Magistrates.
