Delayed judgement on railway worker’s manslaughter case and questions on safety regulations for lone agents on tracks

It will not be for this time yet… The relatives of José Garcia, 49-year-old railway worker died in December 2016 , hoped that the SNCF, referred to justice for “manslaughter”, be judged on Monday but it was not. The criminal court which, last november had ordered additional information, noted that these new investigations had only returned to the file on Monday morning (!), and therefore sent the case back indefinitely (November 6).

When can an agent work alone on the tracks?

On December 6, 2016, José Garcia, an SNCF maintenance agent, was hit by a train while working alone at night for a technical problem on a sign near Nancy station.

During the first examination of this case, last october 10 , and before the court, at the end of its deliberation, decides on additional information, certain crucial questions had arisen: when can an agent work alone on the tracks, as the victim did ? When should he call on a colleague “announcer”, that is to say responsible for warning him of the arrival of trains?
