Proposal to Extend Alimony for Education to Higher Levels for the Best Interest of the Child

In order to guarantee the best interest of girls, boys and adolescents in all areas, the deputy of Morena, Julieta Ramírez Padilla proposed an initiative with which she seeks that alimony not only contemplates the support of tutors during primary education , but that this is mandatory until the minor’s higher education.

Consequently, the legislator indicated that the objective of her project “is that parents or guardians must assume, within the framework of alimony obligations, what includes education starting from initial to higher education.”

Ramírez Padilla recalled that “the current article that governs alimony and alimony as the right of a child under eighteen years of age, in regards to education, is limited to primary education, when it is precisely the third article of the supreme norm of the country, in which it not only requires free education but also compulsory education from initial to higher education”.

In this vein, the deputy from Morena advocated ending the various interpretations and criteria in the courts that have allowed the abandonment of minors regarding their academic training.

And he stated that through the initiative presented to the Permanent Commission, which reforms article 308 of the Civil Penal Code, a human rights perspective is incorporated into the norm and the precept of education expenses is updated.

“As is evident, the norm remains without being updated and here is the opportunity to improve it and update it,” he said.

Julieta Ramírez pointed out that it will be the authorities, especially family judges, who will have the task of correcting and repairing any irregularity that limits or restricts the quality of life of the minor, taking into account that it is a shared obligation, without distinction of gender. .

“There is undoubtedly an urgent need to update this norm, which in its simple reading reveals serious deficiencies and limitations, which can be resolved and overcome with a human rights perspective,” he declared.
