French rugby player Mohamed Haouas sentenced for domestic violence in Montpellier court.

A Montpellier,

The last time he sat on the bench of the defendants, on May 12, in Montpellier (Hérault), Mohamed Houas had promised to “never come back to court” correctional. And yet, it is indeed this same jurisdiction that the pillar of the XV of France faced on Tuesday. But, this time, it was not “youthful mistakes”, a brawl or burglaries, which led him to the bar. This time, the MHR player, whose criminal record already has six mentions, appeared for domestic violence.

Mohamed Haouas, who has been sleeping in pre-trial detention since Sunday, was prosecuted for hitting his partner on Friday evening in Montpellier. He was sentenced on Tuesday afternoon to one year in prison. He will not return, however, to his cell: the sentence, pronounced without a warrant of committal, is flexible. The public prosecutor had requested, against him, two years of imprisonment, including one year accompanied by a suspended sentence.

The player surprised his wife “a cigarette in her hand”

The police arrested the pillar of the XV of France on Friday evening. His wife was at his side, shocked, in tears. “Trembling with fear”, says the file, peeled before the criminal court, this Friday. A few minutes earlier, it was in front of witnesses, at Polygone, that Mohamed Haouas hit her. The cause seems futile: the player surprised her with a cigarette in hand, in front of this shopping center in the city center of the Hérault prefecture, where she has been working for a short time. He didn’t know she smoked.

The player advanced towards her, then caught up with her, as she fled. It was there, in this shopping center, that the Montpellier man put her on the ground, hitting her with a trip. “It was not a big brush, replied the player, questioned in court in front of this gesture of violence. Otherwise, I would have hurt him very badly. Then he slapped her. Before taking her, holding her firmly by the wrist, then by the hand, to the Foch parking lot, 800 meters away, where her car was parked. Marks on the wrist of the young woman prove it. He wanted, he explained, to take her back to her parents.

“This is the first time there has been violence,” said his wife. [Des] disputes, but never violence”

The player assumes the facts. They are, in any case, difficult to dispute: the violence which again brought the terrible child of rugby before the criminal court was filmed by several video surveillance cameras. And detailed by witnesses, whom the couple met on their way. “Come up! “Asked the player to his wife, once they arrived at their car. Witnesses tried to prevent him from leaving. In vain. The car started, before the police stopped it, a little further.

The victim, mother of two children aged 5 and 20 months, who testified at the hearing on Friday, refused to file a complaint and to see a doctor. Because they have two children, because it is necessary to protect the career of the pillar, she detailed, in particular. And because she wants to preserve her couple. “This is the first time there has been violence,” she said. [Des] arguments, but never violence. This is the first time, she promised, that he has “laid his hand” on her. She is a free woman and her husband has “no psychological hold” on her, she said when questioned by the court. Moreover, on several occasions, she made it clear that she did not want to leave him. She wants to talk to him, of course. But leaving him, no. Mohamed Haouas does not prevent her from doing anything, she assured, she is free. He just has “a [mauvaise] experience with cigarettes. He doesn’t like it”. These facts, “she does not endorse them”, assured her lawyer, Florian Medico. But she wanted “to find her husband, this evening, and to discuss it in the intimacy of the couple”.

” I want to apologize. I like you. I did wrong”

The Montpellier player, he assumes. On several occasions, he apologized to his wife, who was sitting a few meters from him. “I was angry, I did not control myself, he confided. I want to apologize. I like you. I did wrong. I am sorry. She’s my wife, we had a fight. It happens. The star of the XV of France tried to justify herself, deploring that she lied to him. Several times, the player said he had doubts about the fact that his companion smoked. A package found in a bag, a smell… “She has the right to do it, she is free, she is of age and vaccinated, he assured. But she didn’t tell me the truth (…) She does what she wants, it’s her health…. But cigarettes are not good for your health. But “that’s not your 10-year-old daughter!” “, then struck him then the judge.

The player also had, we decipher in his somewhat disjointed remarks, doubts about a colleague of his wife. “I made films for myself,” said the player, probably jealous of this man. “I told myself that if she can lie for the cigarette, she can lie for something else (…) I did not control myself. »

“His wife has a new job, she is emancipated, she smokes. He was sure something was up.”

The prosecutor, in her requisition, deplored that we seem to be doing, this Friday, the trial of a woman “who smoked a cigarette”. While, she recalled, the victim was beaten, violently, in a shopping center. “You should not hit a woman, replied the player. I once defended a woman who was beaten by a man. »

Mohamed Haouas will not go to prison. His family, and his lawyer, were relieved at the end of the hearing. “For ten years, he has been a man who has had a normal life, assured Max Gallix, his lawyer. The cases for which he was tried 15 days ago and a year ago are old facts, which date back 10 years. On Friday, he behaved badly. He had a totally inappropriate gesture. Inadmissible. But it is a unique gesture. This is not the usual violence ” Friday, ” he was very jealous. His wife has a new job, she’s emancipated, she smokes. He was sure something was up. »

Marc Gallix also hoped that this would be his client’s last appearance in court. “We gave him a chance, and it was not at all obvious, confided his lawyer. This time, if he doesn’t take it, there’s nothing more we can do. Even I, his lawyer, couldn’t do anything. “The sporting future of the pillar of the XV of France, on the other hand, remains in suspense. Clermont, the club which was to welcome him, no longer seems to want it. Burglaries, violence, domestic violence. It’s too much for a club.
