Law amendments supported by the government provide that marriage can be concluded by two adults, regardless of gender. Along with marriage, the possibility of entering into a registered partnership will also be preserved.
It is also intended to simplify the transition from a registered partnership to marriage.
The government has also supported amendments to the laws that allow the use of rights and obligations under the Registered Partnerships Act.
The draft law also clarifies the regulation of inheritance in the Family Law Act in connection with the right of same-sex couples to adopt.
With the amendments supported by the government, the procedure for making register entries is determined and it is guaranteed that the separate rights of legal spouses are practically also extended to persons in registered partnerships.
The rights and obligations currently provided for in the Registered Partnerships Act will remain unchanged. This also applies to the right of registered partners to adopt only the child of their registered partner.
Registered partnerships provide that the partners have the right to participate in decisions affecting the partner and receive compensation and benefits when necessary.
It is expected that the package of laws, which provides for the legalization of marriages of same-sex couples in Estonia, will enter into force on January 1 next year.
On October 1, the amendments necessary to make register entries for partnerships entered into between January 1, 2016 and December 31, 2023, before other amendments enter into force, will enter into force.
