According to the 2022-2023 academic year calendar of the Ministry of National Education, the second semester break in schools will be held between 17-20 April. How is the Holiday Overtime Fee Calculated and How Many Times the Normal Wage?
Holiday overtime wages are determined as 1.5 times the normal wage. In other words, if a staff worked for a 3-day holiday, let’s say, for example, that the monthly salary of the staff is 5000 TL, let’s first calculate the monthly salary on a daily basis. 5000/30= 166TL for the daily holiday overtime is calculated as 1.5 times the normal daily wage. In other words, the daily wage is 166 TL, assuming that there is a holiday for 4 days, 166×4 = 664 TL, if the monthly wage is 5000 TL, it is reflected in the personnel salary as 5000 + 664 = 5664 TL.
In case of weekend work, the number of hours of overtime work should be calculated by calculating the hourly wage.
Companies that correctly transfer the Bayram additional work wages to the personnel have subsidiary advantages by the government. In the first place, it provides tax advantage due to the taxes paid by the companies to the state, and also increases the trust and loyalty of the employee to the company. The employee provides employee satisfaction, which provides a high performance in return for the right salary, bonus and holiday additional work wage, thus increasing the loyalty commitment between the employee and the employer.
HOLIDAY WORK CALCULATION
Holidays and public holidays are among the days used for resting and spending time with their families. In this context, holidays and feast days are considered holidays by law. However, it may vary in some situations and sectors. Especially in the production, marketing, logistics and service sectors, it is possible to employ personnel on such holidays.
In order to be able to work on official and religious holidays within the framework of the laws of the Social Security Institution, the employer must apply and receive the official permits by paying the necessary fees.
The Law also obliges the employees of the companies to pay holiday overtime over the hourly wage available on special and holiday days.
If the employee applies to the court for overtime wages not paid by the employer on holidays and public holidays, the company is penalized.
On public holidays, overtime wages must be paid by calculating 50% more than the daily wage, and the daily wage is paid as 0 for the holiday work.
The daily working time is determined as 8 hours. Therefore, up to 8 hours, the employer makes monthly calculations over the normal hourly wage. However, daily overtime starts after 8 hours and is added to the calculations. Sundays are a general public holiday and in case of overtime, 0 is calculated over the hourly wage.
In the working areas determined as rotating or shift, there should be especially night shift calculations to be considered. If the holiday work is done as night shift, additional night shift payment should be made separately.
All additional differences, holiday supplement, overtime and night shift wage calculations must be provided on an hourly rate. In case of any conflict, the company’s payment is provided with collective compensation payments as a result of the document review by the labor courts within the framework of the provision of the social insurance law. In terms of employee productivity, it is among the frequently given recommendations that companies do not ignore such important issues.
