Section 16 of UAPA
The Unlawful Activities Prevention Act (UAPA) was enacted in 1967. First, TADA (Terrorist and Disruptive Activities (Prevention) Act) and then POTA (Prevention of Terrorism Act, 2002) were enacted in the name of anti-terrorism. Later, after the protests from the community, all of them were withdrawn. The UAPA Act of 1967 was amended in 2004 and came into its present form.
Section 16 of this is now under discussion. Section 16 makes it an offense punishable by death if an act of terrorism is committed, resulting in loss of life. The minimum sentence is five years imprisonment and it can extend to life imprisonment. And get fined.

Yasin Malik is the person found guilty by the court in the case of killing four airmen in 1990. Yasin Malik was charged under section 16 of UAPA by the then investigating team. The case is pending before the court. Section 16 of the UAPA was also charged against the accused in the Coimbatore blast case.

Discussions are going on at the police headquarters to charge Section 16 of the APA against Shahrukh. Section 16 of UAPA is an offense that causes death by terrorist act. Section 16 of UAPA is an offense punishable up to the death penalty. The investigation team suspects that Shahrukh committed terrorist act. Therefore, the police is moving to charge the case under terrorism-related sections. The police are also investigating if Shah Rukh is connected with any terrorist group.
Shah Rukh’s first statement was that he did the act alone. But Shahrukh gave a statement to the Maharashtra Police that he did the right thing according to the instructions he received. Shah Rukh told the Kerala police that no one else was behind the violence and he was the only one responsible. Shah Rukh says that he did it in his malice. After the fire, he reached Kannur in the same train. He was hiding on the 1st platform while the station was being inspected. Went to Ratnagiri in the morning. The journey was in general compartment. The ticket was not taken.’ The defendant said. Shah Rukh told the police that this is the first time in Kerala. The police is preparing for a detailed examination of the statement.
