Kozhikode ∙ In the PF pension case, RC Gupta, who paved the way for many people to get higher pensions, went to the Supreme Court again against EPFO blocking his pension. The Supreme Court verdict in the RC Gupta case in 2016 was that the cut-off date for giving the option of higher pension was wrong and the option should continue to be accepted. According to this he got a higher pension.
EPFO has now sent a notice withheld the pension by interpreting the decision of the Supreme Court which upheld the judgment of the RC Gupta case on November 4 and said that there is no opportunity to give a new option to those who retired before September 1, 2014.
RC Gupta, who retired from Himachal Pradesh Tourism Development Corporation (HPTDC) as General Manager in November 2008, was given the option in 2016 as per the Supreme Court verdict. The reason for stopping the pension is that it is an option given after September 2014 after retirement.
RC Gupta says:
EPFO is filing 2 cases against the action. These are against withholding of pension and defamation without sending notice or waiting for reply. My organization has been paying proportionally to the actual salary since inception. The option under paragraph 26(6) is required at the time of joining the service. According to this, the higher share is paid. It is a big joke to be asked to personally file a copy of that option online years after retirement. This action is unjustifiable and arbitrary.
The Supreme Court has noted this option in its judgment dated October 4, 2016. The option under paragraph 11(3) and 11(4) was also given following the court order. EPFO is directed to grant new option within 15 days of receipt of notice along with document of grant of joint option under 11(3) prior to 2014. No one in the HPTDC Pensioners Welfare Association intends to give the new option as the option has already been given as per the Supreme Court order. Proceed with the case.
