It took more than a year Kamily Valievaso that at least the decision horizon becomes clear. Recall that the last update to this day was the WADA and ISU appeals against the decision of the independent Disciplinary Anti-Doping Committee (DAC): our side did not find the skater guilty and took away only the gold of the Chechen Republic-2022, while foreign organizations did not agree with this. Today, RUSADA also officially joined the process, also expressing disagreement with the DAK verdict.
Each of the parties to the prosecution demands to recognize Kamila guilty, but the degree of punishment varies: WADA insists on a maximum term of 4 years, ISU gives the time frame to the discretion of the court, RUSADA, among the proposed options, proposes to limit itself to a reprimand.
“RUSADA is seeking the Court of Arbitration for Sport to overturn the contested decision and find the athlete guilty of an anti-doping rule violation and impose sanctions with appropriate consequences (which may include or be limited to a reprimand)”says the CAS release.
Note that the decision of the Russian agency is not a surprise – such a scenario was announced a month ago by the director general of the organization Veronika Loginova. Moreover, if you look at the number of the claim (9451), then our agency filed an appeal in general the very first – earlier than both WADA (9455) and ISU (9456).
What do we get as a result? Surprisingly, there are positives to this as well. Firstly, it is unlikely that anyone will be able to reproach RUSADA for “playing against their own”, because the presence of a prohibited substance in the sample has been proven and beyond doubt, therefore the option of recognizing Kamila guilty, but with a reprimand, is the most politically correct scenario in favor of the athlete. Secondly, RUSADA’s appeal can also be viewed as an indicative unwillingness to go against WADA – we recall that our agency has not yet been restored to its rights.
Sports arbitration, in turn, declares that there are no time limits for the consideration of the case, as well as no deadlines. And even after the decision is made, the process is unlikely to end: CAS is not the last resort, the dissatisfied party will most likely go to the Swiss Supreme Court.
