Defendant Henry Surya was acquitted in a case of alleged fraud and embezzlement of funds Indosurya Savings and Loans Cooperative (KSP).. Henry Surya is considered to have committed a civil act in this case.
“At trial, stated that Defendant Henry Surya was proven to have committed the act charged but it was not a criminal act, but a civil case,” said Chief Judge Syafrudin Ainor at the West Jakarta District Court, Tuesday (24/1/2023).
The judge acquitted Henry Surya from all lawsuits against him. The judge then ordered Henry to be immediately released from the detention center (remand center) after the verdict was read.
“Release Defendant Henry Surya, therefore, from all lawsuits that were previously charged in the first, first and second first alternative indictments,” said the judge.
“Ordered that the Defendant Henry Surya be immediately released from the Salemba Detention Center of the Attorney General’s Branch after this decision was read out,” continued the judge.
Henry Surya was previously demanded 20 years in prison and a fine of IDR 200 billion, a subsidiary of 1 year in prison. Henry Surya was presented virtually in this trial.
“Demands that the panel of judges declare the defendant legally and convincingly guilty of committing an act which those who committed, ordered to commit, and who took part in the act, collected funds from the public in the form of deposits without a business permit from the leadership of Bank Indonesia,” said the public prosecutor. (JPU) at the West Jakarta District Court, Wednesday (4/1).
The prosecutor believes that Henry violated Article 46 paragraph 1 of RI Law Number 10 of 1998 concerning Amendments to RI Law Number 7 of 1992 concerning Banking juncto Article 55 paragraph 1 1 of the Criminal Code.
“Send a sentence against the Defendant with imprisonment for 20 years and a fine of Rp. 200 billion, a substitute for imprisonment for 1 year in prison,” he added.
The prosecutor assessed that the things that were aggravating to Henry Surya, one of which was that Henry had caused economic losses to the victims of IDR 16 trillion.
“That the actions of the Defendant Henry Surya together with witnesses June Indria and Suwito have caused losses to many victims which resulted in the victims experiencing very significant losses and, if totaled, approximately Rp. 16,017,770,712,843,” said Prosecutor.
