The date of the auction of their house is known. It will take place on February 6, 2023. Margaret and Claude Hédouin are about to lose a long legal battle to try not to be evicted from their homes. Morally and physically worn out, the couple who live in Fatouville-Grestain (Eure), near Beuzeville got used to the idea that in a few weeks, they will have to move.
A descent into hell
The couple had testified to their distress in the Awakening of Pont-Audemer of October 20, 2022. In 2014, Margaret and Claude went surety to financially help their son to realize his professional project, that of opening a nightclub in Urou-et-Crennes (Orne). The seller of the establishment offers the son to contract a seller credit of 150,000 euros (the amount of the sale).
But a year after the takeover of the nightclub, the company finds itself in difficulty. The Hédouin family will understand later, despite multiple requests, why the seller had never been able to give them the accounting books. His company just wasn’t profitable. Hédouin’s son fails to repay his loan and files for bankruptcy. In order not to embarrass them, he chooses not to inform his parents.
On June 3, 2015, a bailiff knocks on the door of Margaret and Claudius. He claims 19,000 euros in unpaid monthly payments from their son. Worse, if they fail to pay the bill, their house is in danger of being mortgaged. By signing the deed of sale, Margaret and Claude claim to have never been informed that in the event of difficulties encountered by their son, their house could be seized.
You can imagine that if we had known that we were putting our house on the line, we would never have signed.
In 2016, the couple seizes the tribunal de grande instance of Évreux in an attempt to have the deed of sale annulled. The request is rejected. Unable to settle their son’s debt, which amounts to a total of 160 000 euros, the court confirms the mortgage of the house. He believes that the couple is responsible for this situation.
An over-indebtedness file was filed in 2018 with the Banque de France. It helps to slow down the procedure and restore hope. Finally, the Évreux court confirmed in October 2022 the seizure of the house.
destitute, the couple no longer have any hope of staying in their beautiful country house recently estimated by a real estate expert at 420,000 euros. From now on, his only wish: sell this house at the price it is worth and have enough time to find alternative accommodation. But in the meantime, the couple must absolutely settle their debt of 160,000 euros before February 5 in order to be able to stop the legal proceedings and the mortgage of the house. Thanks to money lent by family members and relatives, the couple managed to raise 110,000 euros. They are missing 50,000 euros.
If we don’t find this amount before February 5, our house will be auctioned off and we will have 60 days to vacate the house.
So Margaret and Claude throw a bottle overboard and call for help one last time. If donors wish to help them, “the sums lent will be paid into an account held by a notary. It is a security to ensure lenders get their money back. We are honest people. We will do this by the rules. And when all the money is paid, the mortgage will be lifted,” says Margaret.
Once our debt has been paid, we agree to sell our house within the following eighteen months and thus repay all those who have lent us money.
