The real estate developer who manages the Greenfield neighborhood in Băneasa accuses Mayor General Nicușor Dan of delaying the implementation of some decisions that would allow cars to access the neighborhood. The allegations made by the company Impact Developer come after Romsilva and the police blocked an access road to the neighborhood on Friday.

Impact shows in a press release that, together with the Bucharest mayor’s office, Romsilva, the Ministry of the Environment and the Sector 3 mayor’s office, set up a legal land swap mechanism that would allow access to car on the road to the neighborhood, through the road The ford of Moldova.

“In the specific case of the stretch of road from Vadul Moldovei street through which access to the Greenfield neighborhood is strictly blocked, the city administration has shown negligence and disrespect for the thousands of people in the Greenfield neighborhood. Delaying the execution of a final court order causes great damage and hardship to the families who live here. A huge neighborhood with residents stressed daily by artificially created traffic jams cannot become a sustainable community. We have consistently championed viable solutions, many funded by us, but in this case passivity, bureaucracy and established blockade affect the quality of life of those who have entrusted us,” said Constantin Sebeșanu, CEO of Impact, according to the quoted statement.

The company points out that, in order to resolve the situation, the General Council of the Municipality of Bucharest must request the Government of Romania to issue a decision according to which the free passage of the road from the public domain of the Romanian state, pursuant to the administration of Romsilva, to the public property of the Municipality of Bucharest, in the administration of the General Council of the Municipality of Bucharest and to the payment of the applicable taxes, for the definitive removal of the land from the national forest fund.

If not, Impact says it will have to file lawsuits to gain right of access to this road, which will benefit more than 6,500 residents in the surrounding area.

The company’s reaction comes after Clotilde Armand, mayor of Sector 1, criticized the closure of the access road and suggested it was “a political decision”. In response, Romsilva indicated in a press release that it had enforced an enforceable court decision.

Access to cars was blocked two days before the start of schools, which will lead to significant traffic jams in the area, which is still served by only one access road.

Over time, aware of the disadvantages and the impact of the closure of the public access to the Road, the Municipality of Bucharest and Romsilva, together with the competition of other authorities such as the Ministry of the Environment and the Sector 1 of the Municipality of Bucharest, have tried to find solutions to unblock this situation.

Therefore, in the period 2017 – 2018, a series of decisions were adopted by the General Council of the Municipality of Bucharest and also by the Local Council of Sector 1 Bucharest which had as their object the measures taken to unblock the situation regarding the Road, meetings were held among the representatives of the concerned authorities, notices were issued by the Romsilva council for the passage of forest roads and related lands from the Romanian state property and the Romsilva administration to the property of the Municipality of Bucharest, between Romsilva and the Sector 1 of the Municipality of Bucharest entered into a usage contract, having as its object the use by the public of two forest roads, with vehicles.

Furthermore, in support of this initiative, IMPACT donated three plots of land with a total area of ​​6,000 m2 and a value of 800,000 euros (excluding VAT), located in the city center of Sector 1 of the Municipality of Bucharest in order to fulfill the formalities for the transfer of the Road from the public of the Romanian state – in the administration of Romsilva, in the public property of the Municipality of Bucharest.

The General Council of the Municipality of Bucharest accepted the donation with obligations and approved the conclusion of the donation contract subject to obtaining Romsilva’s consent.

On 18 May 2018 Romsilva issued the notice relating to the acceptance of the donation.

The Bucharest Municipality accepted the offer on June 13, 2018.

By accepting the donation, the Bucharest Municipality has undertaken to compensate Romsilva for the land received from IMPACT, in order to open public access to the Road, between Aleea Privighetorilor and Șoseaua Pădurea Pustnicu.

Subsequently, on September 20, 2019, Romsilva issued the notice for the definitive removal of the land with an area of ​​3.009 m2 from the Romanian state publicly owned forest fund for the construction of the access road – the beneficiary is the Municipality of Bucharest , as well as for the inclusion in the forest circuit, by way of equivalent compensation, of the donated lands.

Notwithstanding the above, the authorities involved in this process, without legal justification, have stopped carrying out the necessary formalities to allow public access to the Road, respectively to complete the necessary procedures for the transfer of the Road from the public domain of the Romanian State – under the administration of Romsilva, in the public domain of the Municipality of Bucharest.

In particular, the Municipality of Bucharest has not yet fulfilled its obligation to carry out the assignment assumed in the donation contract.

During the year 2022, IMPACT notified all institutions involved, in order to determine the Municipality of Bucharest through the Mayor General to complete these steps. The current situation is the result of the passivity of the Mayor General who refuses to complete the steps described above.

At this moment, the General Council of the Bucharest Municipality must request the Romanian government to issue a decision according to which the free passage of the road from the public domain of the Romanian state, under the administration of Romsilva, to the public domain of the Bucharest Municipality , under the administration of the General Council of the Municipality of Bucharest and upon payment of the applicable taxes, for the definitive removal of the land from the national forest fund.

Otherwise, IMPACT will have to initiate legal action to obtain the right of access on this road, for the benefit of the more than 6,500 inhabitants of the surroundings.

Under these conditions, the only authorities capable of restoring a legal situation will be the courts. While we cannot guarantee the finality of our actions because the courts will be sovereign in adjudicating, we are confident that we will win the case.

Furthermore, in recent years, IMPACT has taken all the necessary measures to build three more access roads to the Greenfield Băneasa complex. To this end, our company has purchased land, invested in technical projects, drafted and submitted documentation, all three projects have been waiting for the approval of the authorities for four years, in each of the following cases there have been delays in their response.

The three projects are in different stages of approval, divided as follows:

The most advanced project refers to the construction of an access road linking the northern part of Aleia Teișani and the Bucharest Ring Road through a shoulder positioned under the Hobanat Bridge on the Bucharest Ring Road. To build this access road, IMPACT bought a land plot with an area of ​​4,150 sq m and submitted in January 2022 all the necessary documentation, including all required approvals, to the Bucharest City Hall in order to obtain the approval of the Chief Architect . After receiving this last opinion, the project will receive the final approval within the General Council of the Municipality of Bucharest.
The second project refers to the construction of an access road through Aleea Teișani in the northern area, respectively the terminal km 1+970 – km 13+987, which will be located in the Greenfield Plaza shopping center area, more precisely near the kilometer 14 of the Bucharest belt. To start the construction, IMPACT still needs to obtain the approval of the Network Coordination Commission of the Bucharest City Hall, where it has submitted the necessary documentation since October 2020. After obtaining it, IMPACT will submit all the documentation to the PMB for approval of the Chief Architect, after which the approval in the General Council of the Municipality of Bucharest.
The third project targeted by IMPACT refers to the development of the intersections between Aleea Teișani and the DN1 interchange, as well as between the DN1 interchange and the Bucharest ring road. This traffic solution would not only improve the access of the residents of the Greenfield Băneasa district, but, according to the studies carried out, it would simplify all the traffic in the Pod Otopeni area on the DN1, an area where there are currently frequent traffic jams, significant parking for length and duration. For the realization of this project, IMPACT has purchased a plot of land with an area of ​​1,000 m2, currently located in the forest fund. Already in December 2020, IMPACT notified CNAIR of the traffic solution it intends to make available, CNAIR being the only institution that can request the subtraction of the land made available by IMPACT from the forest fund.
