Father Magnis talks about 3 moral points to relieve Eliezer in the Joshua murder case

Father Franz Magnis Suseno SJ spoke of factors that could reduce the sentence for Bharada Richard Eliezer Pudihang Lumiu in the murder case of Brigadier N Yosua Hutabarat. Everything?

Eliezer’s attorney, Ronny Talapessy, initially asked what the elements might be for Eliezer’s relief in the Yosua murder case. Romo Magnis then explained these elements.

“In relation to Eliezer’s killing of Joshua, from the point of view of moral philosophy, what are the elements that can lift Eliezer?” Ronny asked.

Romo Magnis said that in this case Eliezer was ordained by his superior who had a much higher rank, namely Ferdy Sambo. The emeritus professor of moral philosophy at Jakarta’s Driyarkara School of Philosophy said there was a culture of “execution” that Eliezer, who ranks far below in the police force, could not disobey.

“In my opinion, the most relieving thing is the position that gives the order, a high position that clearly gives the order that as, in law enforcement it will definitely be obeyed, it is not possible said Eliezer is 24 years old, so it’s still young to do it, the culture is to do it, it’s the strongest element” said Romo Magnis.

Back then, Father Magnis said, Eliezer was in a tense and confusing situation. Eliezer is believed to have no time to think carefully due to limitations in making decisions.

“The second is, of course, the limits of the tense situation which is very, very confusing, I think about all of that, where at that moment he had to decide whether or not to go through with it, there was no time for careful consideration, where we generally try to make an important decision when we first sleep: “You must react immediately. In my opinion, these are definitely two very ethically mitigating factors,” she said.

Romo Magnis also talked about situations where superiors give orders to shoot in military combat. This is why, according to Father Magnis, if a police superior gives the order to ‘shoot’, it makes no sense.

“Another point, in the police as in military combat situations within the police there may indeed be a situation where a superior gives an order to shoot, in all other professions there is no such thing. So that a Police superior gives an order to shoot it’s not entirely for nothing, it makes sense,” said Father Magnis.
