Suspect who shot Abe to be formally prosecuted for murder, prosecutor says he has criminal liability capacity

According to Japan’s “Yomiuri Shimbun” news on December 24, the Nara Prefectural District Prosecutor’s Office in Japan said the same day that, according to the results of the psychiatric examination, suspect Yamagami Toru, who shot and killed former Japanese Prime Minister Shinzo Abe, he also has criminal liability capacity. It is expected to formally prosecute him for murder on January 13, 2023.
On July 8, Shinzo Abe, who was assaulting Abe who was giving a speech on the street in Nara city, Japan, was arrested at the scene and charged with attempted murder. After Abe’s death on July 10, Yamagami was made a murder suspect and his material was sent to the prosecutor’s office. The Prosecutor’s Office has already discussed whether Shan Shang had the ability to bear criminal responsibility and set the four-month period from July 25 to November 29 as the time for Shan Shang’s detention and identification. Medical professionals repeatedly talked to Shan Shang, inquired about his growing up experience and mental state at the time of the accident, and then reported the findings to the Prosecutor’s Office.
The Prosecutor’s Office said on the 24th that Shan Shang’s mental evaluation results showed that she did not suffer from serious mental illness and had the ability to judge right and wrong. To implement the criminal plan, she brought her own gun, investigated the time of Abe’s speech and came up with an accurate attack plan, which should be held criminally liable.
