A software manager from Nantou, surnamed Li, went to study abroad in 2008 at the age of 23 to avoid military service. During this period, the Caotun municipality office in Nantou County sent numerous notices to military service, but Li Nan has still not returned to China. This year, he finally returned to Taiwan, but he was 37 years old and has reached retirement age. The Nantou District Court finally ruled that Li Nan had violated the “Crime of Obstructing Military Service Regulations” and sentenced him to 5 months in prison.

The verdict pointed out that the man surnamed Li went to study abroad in 2008 to avoid military service, and has not returned to China for a long time. After finding out in 2017, the Caotun county township office of Nantou sent letters reminding her many times, and indeed passed on to Li Nan’s parents, but Li Nan still hasn’t returned back to the country on schedule, intending to avoid military service.

The Nantou County Government determined that the Municipal Bureau had repeatedly solicited and delivered the military order, so after sorting out the information, it was transferred to the Nantou District Prosecutor’s Office for investigation. The prosecution believes that Li Nan committed the crime of obstructing male conscription under Article 3(7) of the Crime Regulation of Obstructing Military Service, and made a wanted list for Li Nan.

And Li Nan finally returned to China this year. At the age of 37, he has reached retirement age. However, the prosecution believes that Li Nan intends to avoid conscription, so Li Nan will still be prosecuted. Li Nan also faces a maximum of 5 years in prison.

The judge held that the defendant, Li Nan, knew military service was an obligation, but after being allowed to leave the country, he remained abroad and did not return to China as planned to accept the conscription process and ignored it after being prompted by the military service administration unit. Considering that Li Nan confessed to committing the crime by momentary negligence and still had remorse after committing the crime, he was sentenced to 5 months in prison, suspended for 2 years, and is expected to pay NT $150,000 to the public treasury within 6 months after the verdict was confirmed.
