A petition to veto the bill no. 5655 just hours after it was voted in the Verkhovna Rada it received 25 thousand votes, for the first time in the history of Ukraine.
The Association of Cities of Ukraine (ASU) appealed to the President of Ukraine Volodymyr Zelensky on the use of the right of veto on the bill of Ukraine “On amendments to certain legislative acts of Ukraine on the reform of the sphere of urban development” n. 5655 dated 11/06/2021 adopted by the Verkhovna Rada of Ukraine.

“We believe that the wording adopted contradicts the declared aims of the bill and requires a significant revision. We address to you the request for the application of the right of veto recognized by paragraph 30 of article 106 of the Constitution on the bill n. 5655 and return it for review by the Verkhovna Rada of Ukraine,” the speech said in a statement.
The PSA notes that the current version of the law destroys the idea of an electronic system for zoning regulations, as there is no liability of conservators for non-compliance with or violation of the law. Furthermore, this law legalizes and stimulates illegal construction, since if the court recognizes the illegality of the construction, its cost must be reimbursed from the local budget. And illegal construction, carried out before the entry into force of the law, is legalized. Market access is monopolized. And the exclusively state function of control and supervision over developers is transferred to enterprises. At the same time, the scope for local government and public scrutiny is limited.
“The public is deprived of the right to initiate mandatory building inspections if they detect violations and, therefore, the number of conflicts between the public and developers increases. at least 5 provisions of the Constitution and creates a series of contradictions with the civil code“, ASU points out.
The Association of Cities also recalls that the petition to veto the draft law n. 5655 a few hours after his vote in the Verkhovna Rada it got 25,000 votes, for the first time in the history of Ukraine. And by the time the communiqué was published, the petition had collected more than 42,000 signatures. Numerous comments on the bill were made by the Main Legal Department of the Verkhovna Rada, the Ministry of Culture and Information Policy, the Ministry of Agriculture and Food, the National Agency for the Prevention of Corruption and other organizations and public institutions.
“Representatives of local self-government hope for the support of the President of Ukraine and the preservation in Ukraine of all the achievements of decentralization achieved in recent years,” the ASU notes.
