At the beginning of the message, Canal+ explains the legal basis for the changes.

– Canal+ Polska SA with registered office in Warsaw informs that due to the entry into force from 1 January 2023 of the law of 4 November 2022 amending the Consumer Rights Act, the Civil Code Act and the Private International Law Act, transposing Directive (EU) 2019/770 of the European Parliament and of the Council of 20 May 2019 on certain aspects of contracts for the supply of digital content and digital services into Polish law (OJ L 136, 22.05.2019, page 1 and Official Journal of the EU L 305 of 26/11/2019, page 60) and Directive (EU) 2019/771 of the European Parliament and of the Council of 20 May 2019 on certain aspects of sales contracts of goods, amending Regulation (EU) 2017/2394 and Directive 2009/22/EC and repealing Directive 1999/44/EC (OJ L 136, 22.05.2019, p. 28 and OJ L 305, 26.11. 2019, page 63 ), from 1 January 2023 the new Canal+ Services Regulations (“Regulations to”). This is due to the need to adapt the Regulation to the new provisions referred to above. Please read the information below.

The entry into force of the new Regulations does not affect the services you currently use, in particular, neither the prices of your services nor the additional packages/options you use as part of Canal+ online will change. The new Terms and Conditions apply from the first renewal of the subscription to the service, which will take place after January 1, 2023. Until then, the current rules apply. If you do not accept the new Regulation, you can cancel the renewal of the subscription to the services which would take place after January 1, 2023.

What will change in the legislation?

Compared to the regulations sent to subscribers in the summer of 2020, additional points have appeared in the new one. They show that if the service provider has not provided the service, the customer requests that it be provided, and the service is still not provided, the customer can withdraw from the contract. This can also happen if the service was not delivered on time which was important to the customer. Such a record can be combined with live sports broadcasts. Streamers want to watch a game live, not after it’s over, as was sometimes the case on Viaplay. The Canal+ online service must be activated within 12 hours of the conclusion of the contract, which the broadcaster had not disclosed in the regulation 2 years ago. The service provider must now also inform the customer about website and application updates in advance. If the user does not install the update in time, Canal+ is not responsible for technical problems.

There is also a point in the regulations regarding the change of services. Canal+ reserves the right to modify the service (television channels or on-demand content) due to loss of production data distribution rights, their low number of viewers, insufficient technical quality, mergers or acquisitions of companies with the participation of the service provider resulting in reorganization of its activities, changes in the law, changes in the number of users of the website, changes in trade names or technical standards or simply force majeure. Canal+ must inform you in advance of any changes. Two years ago, these provisions were included in the section on amending the regulations.

Canal+ does not provide the number of subscribers

In the first nine months of 2022, the Canal+ Group recorded a 1% increase in revenues. compared to the first three quarters of 2021. Revenue amounts to 4.292 billion euros. This result is responsible for the growing demand for pay TV in developing countries, where Canal+ is investing more and more.

Financial results in the third quarter appeared less optimistic. Canal+ Group by 3.3%. compared to the third quarter of last year They amounted to 1.467 billion euros then and now they amount to 1.419 billion euros. In the French market, the Canal+ Group’s revenues increased by 1.3% in the first three quarters and by 6.3% in foreign markets. In the third quarter in France they decreased by 3.5 percent, while in the other markets they increased by 1.5 percent. Data on the number of subscribers and subscribers was not provided. At the end of the first half of the company reported that it had 23.9 million. The latest data from Poland dates back to a year ago, when Canal+ had 2.7 million customers.
