Santiago. The Prosecutor is asking for three years in prison for a crime of fraud for a lawyer who in 2014 promised to defend some clients – who came to make payments – and not fulfill his mission, which is why he is also accused of a crime of unfair professionalism. He will be tried in Section 2 of the Provincial Court of A Coruña next Thursday, 10 November.
According to the Public Prosecutor’s Office in his memory, the accused, a collegiate lawyer who worked in a law firm in La Coruña, was hired in September 2014 by the victim to defend his sentimental partner and his son, both in temporary prison.
After contacting the two detainees, “he promised them that he would get their release within about a month”, preparing the defense of both once they were released, in view of the trial that would take place and in which they appeared as defendants. The defendant presented himself as defender of both and filed a summons dated 17 October 2014.
The above required the contractor to provide funds for two payments of 3,000 euros in September and December 2014, in addition to 600 euros in November for the payment of the lawyers.
At no time did he submit to the competent court an act establishing the detention of the father and son until the time of the trial.
For all this, the Public Prosecutor asks for a sentence of three years of imprisonment, four years of special interdiction from practicing the legal profession, in addition to compensation for damages in cash deliveries and compensation for non-pecuniary damage. ep
