“BPOM cannot be institutionally punished, but if there are unscrupulous employees and officials who neglect drug control, they can be charged with negligence as worded in the Criminal Code,” Santoso said in a written statement Thursday (10/27/2022 ).
He explained that negligence, negligence, or guilt are types of errors in criminal law due to a lack of caution so that something happens accidentally. He said negligence that led to another person’s death could be punished under Article 359 of the Penal Code.
“Whoever by his mistake (negligence) causes the death of another person, is threatened with a maximum imprisonment of 5 years or a maximum imprisonment of 1 year. In addition, he can also be trapped in the article of participation referred to in Article 55 of the Criminal Code “, he explained.
In addition, he also asked the police to act decisively and thoroughly investigate this case. According to him, this case involved the lives of many of the nation’s next generation children.
“National police must be firm. If there are BPOM officials or staff who do not cooperate in providing information on drug data to law enforcement, they can be accused of obstructing the investigation. Law, gas pol only,” he said.
