It has already been reported that on Wednesday the municipal police of the Mārupe region received information about a possible illegal act, the felling of a nationally protected giant oak on Kantora Street, according to information on the municipality’s website.

After the inspection, information on the possible criminal offense was sent to the State Police and the Department for Nature Protection (DAP).

Construction work on the terraced house project “Dižozolu nami” is underway near the sawn giant oak. According to the city council, at the beginning of the year, the residents of the surrounding houses appealed to the municipality, the DAP and other responsible bodies, trying to make sure that the dižozol is not affected during construction work.

As the LETA archive shows, in the summer of this year, in an attempt to save the giant oak, the Attorney General filed an application for renewal of the administrative proceedings in connection with the decision of the County Council to the District Administrative Court. di Mārupe will issue a building permit for the construction of terraced houses of the aforementioned project.

On July 29, the Attorney General’s Attorney General filed with the District Administrative Court for renewal of the administrative proceedings for newly discovered circumstances in the case of building permits issued illegally by the Mārupe County Building Board – the Mārupe County Council restored operation of the building permits issued illegally with his decision, he informed the prosecutor’s office.

It has already been reported that on February 14, the Attorney General received a DAP request relating to the damage to a natural monument – a large tree – in Kantora 115 and 117, Mārupe, during the construction of a new terraced house .

During the examination by the public prosecutor of the facts mentioned in the application, it was found that the building council of the county of Mārupe acted illegally by issuing building permits for the construction of terraced houses at the addresses mentioned, which are located in the territory of the natural monument – dižozol.

On April 8, the Public Prosecutor’s Office filed an appeal with the District Administrative Court with a request for the cancellation of the illegal building permits and the restoration of the original state.

Without waiting for the conclusion of the legal proceedings, on 12 April the building of the district of Mārupe canceled the building permits issued illegally and imposed on the builder the obligation to restore the original state of the buildings. The contested administrative act having been annulled, the court, on May 13, 2022, decided to close the proceeding in the present administrative case.

At the July 7 emergency meeting, the Mārupe County Council overturned the April 12 building council decision and restored the previously disputed building permits to functioning.

Therefore, the prosecutor again challenged the District Administrative Court in accordance with the procedure provided for by law – with a request for renewal of the administrative procedure for newly discovered circumstances.
