After a judge ruled that Jeanine Añez I can not have a judgment of responsibilityhis lawyer Alaín de Canedo indicated that “sooner or later” the state will have to pay a millionaire compensation to the former president and do not rule out bringing the case to Inter-American System of Human Rights (SIDH).
The affirmations occur later Judge Heber Torrejón found that Añez had not assumed the presidency in a constitutional way and that, according to its criteria, a judgment of responsibility corresponds only to constitutional presidents.
The defense of the former president criticized the decision and criteria of the judge, citing Article 184 of the political constitution of the state, which states that a president must be tried in the Supreme Court, subject to the approval of the Legislator, for crimes committed in the exercise of his functions.
De Canedo mentioned, in an interview with radio Erbol, the hypothesis that even in the “absurd case” that Añez was “de facto” president (which the judge could not determine) and Even if he had committed a flagrant crime, he would still be faced with a process of accountability. He stressed that even the dictator Luis García Meza has not been denied the right to a trial for accountability. In this sense, he assured that Judge Torrejón wiped out 200 years of legal history in Bolivia with a “punch”, where there were 20 trials of this type.
Añez’s lawyer also said that, once internal remedies are exhausted, it is planned to take this case to the Inter-American System of Human Rights, where Only the violation of Article 184 of the Constitution would have to be proven to have a ruling in favor of the former president.
He acknowledged that the process could take a long time, recalling, for example, that in the question “Hotel Las Américas”, registered in 2009, only this year the IACHR published a substantive report, but, in any case, foresees that, at some point, the state will have to compensate Añez or his descendants.
“Sooner or later, maybe it’s not me, maybe it’s obviously someone else, but sooner or later, this obviously will result in a millionaire compensation, in a sanction against the State ”, said De Canedo in ERBOL’s La Tarde en Directo program and added that with this decision the country’s image will suffer and it will be established that there is no rule of law.
The jurist explained that, once this compensation has been paid, the State will be able to carry out the repetition action, that is prosecute the officials who caused this economic loss to compensate it. Thus would be involved judges, prosecutors, administrators and all those who have had to do with the violation of the constitutional rights of Jeanine Añez.
