The Sofia City Court found him guilty, but he punished him with an administrative fine
Varna investigator Atanas Ilchev was found guilty of preventing the traffic police from testing him for alcohol and drugs, but for this he was only punished with an administrative fine, according to an investigation by “24 Chasa”. The verdict of the Sofia city court is from Monday. According to her, Ilchev has to pay 1,000 BGN for breaking the law.
The case dates back to June 26 this year. At 19:00, the magistrate drove his car along the “Hemus” highway from Shumen to Varna. In the 373rd kilometer area, Ilchev’s car crashed slightly. A police patrol from Provadia arrives at the scene. According to the road traffic law, MIA officials must check his documents and test him for alcohol.
At first, the team’s junior auto inspector took over this task. He asked for Atanas Ilchev’s identity card and driver’s license. Then the investigator counterattacked. He asked the police officers to identify themselves. He stated that he would not take an alcohol test until he took pictures with his cell phone at all in uniform. Then he pulled his device out of him. He began to approach the policeman despite the latter’s insistence not to. “Are you going to hit me?” Ilchev asked. He then retorted that his surname was easy to remember and that he was very accommodating. He also said he would send greetings to the families of those in uniform. Subsequently, the police prepared the addict for alcohol. So investigator Ilchev knowingly provided two invalid samples. He exhaled insufficient volume of air into the mouthpiece, not as prescribed – slowly and deeply.
The officers reported to their superiors and preliminary proceedings were initiated. The case is in Sofia, where the magistrates are investigating. He is accused of obstructing a public authority in fulfilling his duties of him. The punishment is up to 3 years’ imprisonment or a fine from BGN 500 to BGN 2000. Due to the low public peril and extenuating circumstances, investigator Ilchev was punished by the court with an administrative fine. The sentence for Atanas Ilchev is not final and can be appealed to the Sofia Court of Appeal. Disciplinary proceedings are also pending against him in the High Council of the Judiciary.
