DIJON: Reception of Saint-Etienne supporters under conditions for the DFCO-ASSE match

The Côte-d’Or prefecture has issued two decrees to strictly regulate the coming to Dijon of supporters of the Saint-Étienne football club this Saturday, July 30.

Decree of the prefecture of Côte-d’Or of July 27, 2022:

Prefectural decree No. 933 on the supervision of supporters during the football match of July 30, 2022 between Dijon Football Côte-d’Or (DFCO) and the Association Sportive de Saint-Étienne (ASSE)

CONSIDERING Decree No. 2004-374 of April 29, 2004 as amended relating to the powers of prefects, the organization and action of State services in the regions and departments;
CONSIDERING the decree of February 25, 2022 appointing Mr. Frédéric CARRE, secretary general of the prefecture of Côte-d’Or, sub-prefect of Dijon;
CONSIDERING the circular of the Minister of the Interior INTK2127556J of September 10, 2021, supplemented by the circular INTK2133195J of December 31, 2021 relating to administrative police measures to combat violence in stadiums;
GIVEN the circular from the Minister of the Interior INTD2205085J of April 25, 2022 relating to risky sporting events and bans on the movement of supporters;

CONSIDERING that under Article L. 332-16-2 of the Sports Code, the representative of the State in the department may, by decree, restrict the freedom to come and go of persons availing themselves of the quality of supporters of a team or behaving as such on the premises of a sporting event and whose presence is likely to cause disturbances to public order;
WHEREAS the Association Sportive de Saint-Étienne (ASSE) will meet Dijon Football Côte-d’Or (DFCO) on Saturday July 30, 2022 at 3:00 p.m. on the occasion of the first day of the French Ligue 2 football championship;
WHEREAS this sporting event will generate a large flow of spectators with at least 10,000 people expected;
CONSIDERING that the behavior of the supporters of Saint-Étienne is regularly likely to disturb public order during meetings at home and during trips; that it is therefore appropriate to recall the violent incidents which occurred during the Jura Sud / ASSE meeting on January 2, 2022 during which the Saint-Etienne supporters lit smoke bombs and mortars; and the ASSE / AJA Auxerre match of May 29, 2022 during which Saint-Étienne supporters invaded the field;
CONSIDERING that due to the disagreements and hostile demonstrations of the Saint-Etienne supporters towards some of their leaders, the risk of disturbances to public order has been proven during this meeting;
CONSIDERING the short distance between Dijon and Saint-Étienne, a significant movement of Saint-Etienne supporters is foreseeable;
CONSIDERING the classification of the match by the National Division for the Fight against Hooliganism in level 2;
WHEREAS the local security forces are also mobilized to ensure the safety of the population in the sensitive neighborhoods of the Dijon conurbation, currently the scene of numerous acts of urban violence;
CONSIDERING that the mobilization of the forces of order will not be able, in the absence of the adoption of supervision and restriction measures, to ensure the safety of persons and in particular those of the supporters;
ON the proposal of the secretary general of the prefecture of Côte-d’Or,

STOPPED

Article 1: On Saturday July 30, 2022, supporters of the Association Sportive de Saint-Étienne (ASSE) will be able to attend the match against Dijon Football Côte-d’Or (DFCO) at the Gaston Gérard stadium, within the limit of 450 supporters maximum, in the parking lot provided for this purpose and according to the following conditions:
– supporters must hold a ticket purchased in advance from ASSE,
– the trip will be made exclusively by bus and minibus,
– a mandatory meeting point is set for Saturday July 30, 2022 at 12:30 p.m. at the A311 motorway exit – Péage de Dijon Sud in Perrigny-les-Dijon,
– the supporters will be escorted at 12:40 p.m. by the internal security forces from the meeting point to the visitors’ parking lot of the Gaston Gérard stadium according to a route imposed by the police,
– from their arrival at the stadium, and until the moment of their departure, ASSE supporters may not leave the visitor parking lot,
– at the end of the match, the supporters will return to the visitor parking lot without delay. They will again be escorted back to the highway.
Article 2: On Saturday July 30, 2022 from 10 a.m. to 10 p.m., the possession, transport and use of any pyrotechnic article and any object that can be used as a projectile are prohibited within the perimeter defined in the appendix.
Article 3: This decree may be the subject, within two months of its publication in the Prefecture and in the town hall, of a contentious appeal before the administrative court of Dijon which may be accompanied by an appeal in summary proceedings. provided for by article L. 521-2 of the code of administrative justice.
Article 4: The secretary general of the prefecture of Côte-d’Or, the chief of staff of the prefect of the Bourgogne-Franche-Comté region, prefect of Côte-d’Or, and the departmental director of public security are responsible, each in his own sphere, for the execution of this decree which will be published in the collection of administrative acts of the prefecture, transmitted to the town hall of Dijon and sent for copy to the public prosecutor at the judicial court of Dijon.

CONSIDERING that under these conditions, the presence in downtown Dijon of people claiming to be supporters of the Saint-Étienne club or behaving as such, during the match of July 30, 2022, involves risks serious for the safety of people and property;
ON the proposal of the secretary general of the prefecture of Côte-d’Or,

STOPPED

Article 1: On Saturday July 30, 2022 from 10:00 a.m. to 10:00 p.m., it is forbidden for anyone claiming to be a supporter of the Association Sportive de Saint-Étienne (ASSE) or behaving as such, to access the centre- city of Dijon within the perimeter delimited in the appendix.
Article 2: Are prohibited within the perimeter defined in article 1, the possession, transport and use of any pyrotechnic device, firecracker and smoke and any object that can act as a projectile.
Article 3: This decree may be the subject, within two months of its publication in the Prefecture and in the town hall, of a contentious appeal before the administrative court of Dijon which may be accompanied by an appeal in summary proceedings. provided for by article L. 521-2 of the code of administrative justice.
