Defendant Adam Deni Gearaka and Ni Made Dwita Anggari was sentenced to 4 years and a fine of Rp. 1 billion subsidiary 5 months in prison related to the case of information and electronic transactions (ITE) uploading a bicycle purchase document belonging to Deputy Chairman of Commission III Ahmad Sahroni. The judge stated that Adam Deni and Ni Made were guilty of intentionally and without right to violate the law in any way changing, adding, deleting, transmitting, destroying, transferring and hiding other people’s confidential electronic documents.
“Trying, declaring the defendant Adam Deni Gearaka and Ni Made Dwita Anggari have been proven guilty of committing a criminal act intentionally without any rights against the law in any way changing, adding, reducing, transmitting, damaging, transferring and hiding a confidential electronic document of another person which resulted in the disclosure of confidential information. ,” said Chief Justice Rudi Kindarto at the North Jakarta District Court (PN Jakut), Jalan Sawah Besar, Central Jakarta, Tuesday (28/6/2022).

Adam Deni and Ni Made were found guilty of violating Article 48 paragraph (3) in conjunction with Article 32 Paragraph (3) of the Law of the Republic of Indonesia Number 11 of 2008 concerning Information and Electronic Transactions as amended and added to the Law of the Republic of Indonesia Number 19 of 2016 concerning amendment to the Law of the Republic of Indonesia Number 11 of 2008 concerning Information and Electronic Transactions in conjunction with Article 55 Paragraph (1) of the 1st Criminal Code.
It is known that the prosecution Adam Deni Gearaka and Ni Made Dwita Anggari 8 years in prison for this case. The aggravating thing was that the two defendants were sentenced to 8 years in prison because they did not show remorse during the trial.
“The defendants did not show any remorse during the trial,” said the public prosecutor at the North Jakarta District Court (PN Jakut), Jalan Gajah Mada, Central Jakarta, Monday (30/5).
The prosecutor assessed that the two defendants had not behaved well during the trial process. This, said the prosecutor, was revealed by a commotion in the court during the trial process.
“The defendants did not behave well during the trial process with some commotion in the court during this trial,” said the prosecutor.
The prosecutor also said that the two defendants were convoluted when giving testimony at trial. As for mitigating factors, the two defendants have never been convicted.
“The defendant was complicated in providing information,” said the prosecutor.
“The mitigating thing is that the defendants have never been convicted,” he added.
Adam Deni and Ni Made Dwita Anggari were charged with transmitting and transferring other people’s confidential electronic documents.
