Crazy rich Samin Tan turned out to be directly facing the KPK prosecutor’s cassation request for his acquittal in the first instance court. Samin Tan directly faced the KPK’s appeal without the assistance of a team of lawyers.
This was conveyed by Radhie Noviadi Yusuf. Radhie is currently a former lawyer for Samin Tan. He became Samin Tan’s lawyer from the investigation stage to the trial at the Jakarta Corruption Court.
“In the cassation process, Mr. Samin Tan stepped forward himself without using legal counsel,” said Radhie when confirmed, Monday (13/6/2022).
Radhie says she just helped prepare counter cassation memory. After that, Samin Tan took care of everything himself.
“I only helped prepare the counter memorandum of cassation, which was filed administratively by Pak Samin Tan directly,” he said.
According to Radhie, the decision of the Supreme Court (MA) which rejected the KPK prosecutor’s appeal was correct. He said the decision was in accordance with the applicable legal theory.
“If the response to the decision is in accordance with theory, the gratuity giver does not have any offense, moreover I also have another corruption case against the KPK, the KPK prosecutor during the trial always said that the gratuity giver cannot be punished, his opinion is the same,” he said.
It is known that the Supreme Court rejected the KPK prosecutor’s application for the acquittal of Samin Tan. The Supreme Court confirmed that Samin Tan remained free because he was not proven to have bribed the former Deputy Chairperson of Commission VII DPR, Eni Maulani Saragih.
“Reject,” reads the short decision of the Supreme Court which was published on its website, Monday (13/6).
Sitting as chairman of the Suhadi assembly with members Suharto and Ansori. The verdict was announced on June 9, 2022, with a substitute clerk for Dwi Sugiarto.
