In some cases, the judge affirms, one cannot “even speak properly of plagiarism”, because the words reported as copied belong to works by authors such as Wilde, Scott Fitzgerald, Garcia Lorca or Cesare Pavese dead for more than 70 years, after which copyrights expire and “the work can be represented and even reworked by anyone”.

In other cases, these are expressions “of such common use as to make one doubt that they enjoy copyright”. In the book, according to prosecutor Vincenzo Fiorillo, the part of a 2013 interview in which Baglioni affirmed is reported that: “There might be a day when maybe I will steal something. If a sentence arrives, but I will say it explicitly, that it is beautiful, that it is there, I will say this one has reached me … »; but not the next one: «As perhaps I have stolen on other occasions, like so many of us. Some openly plagiarized, others were inspired, cited works that already existed ». “Partial and manipulated” quote that makes him “pass for one who copies systematically, without ever saying it,” writes the investigating judge.

And then «it cannot be said that Claudio Baglioni is a “plagiarist” (at least, not for all the citations charged to him), nor that he systematically and fraudulently conceals the alleged plagiarism from the public, in part because it cannot always be said that he really copied the others, in part because he has sometimes admitted to citing the works of others “. Also criticized the approach to Lurch, the character of Addams family, with an «evident sarcastic allusion to the circumstance that the singer would have redone his face thanks to cosmetic surgery» which turns out to be «a free attack on the person, given the overall defamatory context». Even the accusation of having copied some sketches for the Sanremo festival, directed by Baglioni in 2018 and 2019, would be defamatory, because he was not the author.
