A former bank chief sentenced the prosecutor’s office to nearly BGN 1 million for the accusation, which was dropped a year and a half later due to lack of evidence. The record compensation awarded by Judge Bogdana Zhelyavska of the Sofia City Court amounts to BGN 200,000 for non-pecuniary damages and BGN 737,889 for pecuniary damages.
Gennady Tabakov, who in 2001 was the executive director of CCB, filed a lawsuit against the prosecutor’s office in 2020. The reason – on February 17, 2017 he received an accusation from the district prosecutor’s office in Targovishte that he did not declare in court that his company insolvent. On April 10, 2018, the prosecutor’s office filed the indictment in the district court in Targovishte, which returned it to correct procedural violations. On July 27, 2018, the case was terminated because no evidence of a crime was found. The Targovishte District Court upheld the ruling.
According to Gennady Tabakov, “his illegal involvement as a defendant in something that does not constitute a crime and in criminal proceedings” caused him extremely large and irreparable property damage. Also stress that led to

After he was indicted, Tabakov could not run the institution, which he informed his partners about. This led to the company’s bankruptcy in 2018.
The prosecutor’s office disputed, arguing that the accusation had never been made public, so his reputation could not be tarnished. A witness who had known the financier for 15 years was questioned in the case. He explained how a good business man lost his job.

The court found that the actions of the public prosecution “contradict the basic principles of the European Convention on Human Rights.”
As a result of the unjust accusation, he suffered moral pain and suffering, which resulted in damage to prestige and good name in front of society, colleagues, family and friends, stress and worries, said Judge Bogdana Zhelyavska.
He was forced to retire and cease his work and activities – both his own and that of the company he ran. “He received mental trauma, which has not subsided so far, and the resulting stress has led to illness,” said the judge.
Therefore, she awarded BGN 200,000 in compensation for non-pecuniary damages and BGN 737,889 for pecuniary damages, of which BGN 188,697 as a result of the sale of his home in Varna by a private bailiff. The court’s decision is not final.
Ten years ago, Tabakov’s company attacked in court the ordinance, which allows only the state post offices to distribute pensions. According to the website bird.bg, his name was present in the notebook of Yordan Mollov in order for a SWEEFT translation to be made. Mollov and Kiril Jabarov are under investigation for a financial pyramid.
