La Paz, Baja California Sur.- Lawyer Arturo Rubio Ruiz reiterated the call to the Congress of Baja California Sur (BCS) to call to account and remove the president of the State Superior Court of Justice (TSJE), Daniel Gallo Rodríguez.
The legal professional stressed that in December 2021, prior to the close of the first ordinary period of sessions, he submitted a request, before the Legislative Power, for the removal of the presiding magistrate of the Judicial Power.
“He has been illegally in the job for 11 uninterrupted years, when the local Constitution – in force until 2021 – set a three-year limit to hold the job,” he said.
He said that the term for the commission to which said initiative was turned over to issue the opinion has already expired, without having pronounced on my specific request.
He explained that “the issue motivated them, and although they have not ruled on the dismissal of the public servant who practices illegally, a constitutional reform was generated in the inter.”
“You considered that three years is a long time and there is a risk that limits of power will be created, -especially in transexennial periods-, so you modified the Constitution and reduced the period to occupy the presidency from three to two years. of the Court. This is established in the reform published last month”, he stressed.
In this context, he questioned that if three years is a long time, why do they allow this official to remain illegally for eleven years in the presidency of the court?
Rubio Ruiz asked the members of the XVI Legislature for consistency and called them to act accordingly.
