Jakarta

Lokataru Director, Haris Azhar |and KontraS Coordinator, Fatia Maulidyantiplans to file a pretrial lawsuit on the status of a suspect in a defamation case Coordinating Minister for Maritime Affairs Luhut Binsar Pandjaitan. How did the Polda Metro Jaya respond?

“Pretrial is indeed the suspect’s right, go ahead. If you feel there are objections regarding the determination of the suspect, detention, search, confiscation, please submit (pretrial),” said Head of Public Relations of Polda Metro Jaya Kombes Zulpan when contacted detik.comSaturday (19/3/2022).

Zulpan said his party was ready to face pretrial. He said the pretrial judge would examine whether the police had violated the rules in the procedure for determining the suspect.

“The police are open to it. Of course later the court will also test it,” he added.

Previously, attorney Haris Azhar |, Nurkholis Hidayat, said that his party would take legal action to fight against the determination of this suspect status. Pretrial measures will be taken if the internal mechanism is not working effectively.

“In the context of the suspect’s rights, of course we will continue to ask for mitigating witnesses, more independent and accountable experts, who must be examined by the police which leads to the conclusion, review on the clarity of whether or not there was a criminal act in this case,” said Nurkholis in a virtual conference, Saturday (19/3/2022).

“If all these internal mechanisms do not work effectively, we will face them in the court process and we will file a pretrial,” he continued.

In addition, Nurkholis questioned the attitude of the police who were considered to have ignored the evidence submitted by his client regarding the results of research involving names Luhut Binsar Pandjaitan. In fact, at that time, in their research findings that had been submitted to the police, there was evidence of Luhut’s involvement in the mining business in Papua.

“Our client has submitted evidence and other information that reveals at least there is conflict of interest in the mining business and military mobilization there. It came out in the verbal process of clarification so far,” explained Nurkholis.

“Of course, during a police investigation process, there are other criminal acts that are clearer that the police should investigate and prioritize them. So in this context, investigations into the people or parties involved, including the allegations here were also carried out by the LBP as stated in the research. it,” he added.

The Jakarta Metro Police have named Haris Azhar and Fatia Maulidiyanti as suspects in the Luhut Pandjaitan defamation case. Both will be questioned as suspects on Monday (21/3) the day after tomorrow.
