The Court of First Instance No. 15 of Madrid has dismissed the precautionary measures requested by Real Madrid, Barcelona and Athletic against two of the agreements adopted at the Extraordinary General Assembly of the National Professional Football League, held on December 10, 2021. Those The agreements led to the approval of the operation between LaLiga and the CVC Capital Partners Fund, by which the Spanish football employers will receive 1,994 million euros in exchange for 8% of the profit in the next 50 years of the clubs, which have already received some 800 million euros from the fund.
These three teams contrary to the agreement intended with the request for precautionary measures to avoid the damages that could occur if the suspension was not adopted, but the judge considers that suspending the approved agreements “would suppose the paralysis of effects already initiated or executed, accepting and superimposing the criterion of a minority against the election carried out and consented by the majority”. Of the 42 clubs, only the three plaintiffs and Ibiza voted against and Oviedo abstained. Against the adopted decision it is possible to appeal.
