Higher Regional Court Hamm: Result of the negotiation on claims for damages by a real estate company against an insurance company

The 8th civil senate of the Hamm Higher Regional Court today negotiated the lawsuits of a real estate entrepreneur from Aachen and a real estate fund, whose managing partner is the real estate entrepreneur, against an insurance company from Dortmund that is a limited partner in the real estate fund. The plaintiffs want to know that they can claim damages from the defendant insurance company, which is said to have run a character assassination campaign. In addition, the complaining real estate entrepreneur demands compensation for pain and suffering of at least 100,000 euros.

The Senate discussed in detail the factual and legal issues pending decision in today’s oral hearing with the parties present and their lawyers. The Senate has made it clear that it shares the assessments made by the Regional Court, at least in terms of the result.

However, the Senate would like to discuss the individual aspects in more detail and give the parties the opportunity to comment on today’s discussions. Therefore, he has set an appointment for the announcement of a decision on March 28, 2022. The parties do not have to appear on this date.
