The trial against the Argentine actor Juan Darthés, accused of raping actress Thelma Fardín
A source from the federal justice of Sao Paulo confirmed that the trial in the first instance on this case, which is under summary secrecy, should start this Tuesday with the statements of witnesses in a virtual hearing that could last until Wednesday.
The case, in which the Brazilian, Argentine and Nicaraguan justice collaborate, caused a strong commotion in Argentina, where Fardín is from
In December 2018, Fardín reported to the Nicaraguan prosecutor’s office that Juan Darthés (57), the stage name of Juan Pacífico Dabul, He would have raped her in a hotel room in May 2009
A year later, the Nicaraguan prosecutor’s office accused the actor – who also has Brazilian nationality and has settled in that country since the complaint – of raping Fardín in a hotel in Managua, “using job trust and the difference in age.”
When the events occurred the actress was 16 and the actor 45.
The Brazilian Constitution does not allow the extradition of nationals, but the Penal Code does allow for the prosecution of Brazilians in its territory for crimes committed abroad. In April 2021, the São Paulo prosecutor’s office presented a complaint that was accepted by the courts.
“ I come to the trial tired, but also with the certainty that this is where I should be
In the few times he spoke of the case, Darthés has rejected the charges against him
The collective Actrices Argentinas, which promoted the trial, read this Tuesday a manifesto in support of Fardín in front of the UFEM, where the actresses Calu Rivero and Anita Co must also testify, who in turn denounced Darthés for sexual harassment and abuse.
“We are together again to embrace Thelma, ask that her abuser be convicted and reaffirm that despite all the obstacles, this is a path that for women and dissidents in Latin America has no turning back,” reads the manifesto.
