jpnn.com, JAKARTA – The Supreme Court (MA) has reduced the sentence for former High Priest of the Islamic Defenders Front (FPI) Habib Rizieq Shihab related to the case of spreading false news about the Covid-19 swab test at Ummi Hospital, Bogor, West Java.
The Supreme Court decided the prison sentence for Rizieq Shihab for two years, the previous sentence at the DKI Jakarta High Court was four years.
MA spokesman Andi Samsan Nganro explained that the decision was an appeal that was decided by the Chairman of the Cassation Council, Suhadi, as well as members of the Assembly Suharto and Soesilo. The verdict was recorded by the substitute clerk for Agustina Dyah.
“Improvement of imprisonment to two years,” said Andi Samsan when confirmed, Monday (15/11).
The verdict, said Andi, was decided by the assembly on Monday afternoon.
While related to his case, Habib Rizieq is still being charged using Article 14 paragraph 1 of the Republic of Indonesia Law Number 1 of 1946 concerning the Criminal Law Regulations in conjunction with Article 55 paragraph 1 of the Criminal Code.
In that decision, the judge has his own considerations. That even though Rizieq had committed his act of spreading false news that caused trouble, the incident was only crowded in the mass media.
The judge considered that there were no physical or mental victims to property as a result of Rizieq’s actions. The judge also saw that Rizieq had been sentenced from other cases that were included in the Covid-19 series.
