SEPARATE THE POLICY. Consulting the opinion of former judge Miguel Tadeo Fernández, he assured that he cannot say that the Jury is a tool to prosecute politically, but he assured that politics must be separated.
“The Jury is an institution where logically the selection is of a political nature and the solutions could have a political result. What it should do is move away from the political and establish itself exclusively as a legal institution, “he mentioned.
Fernández said that our system must make some change. “We must separate these two bodies and make them up with people who are not from the political class and who are not elected by them.”
He argued that the JEM is a body to sanction and see where the bad performance is. He mentioned that it is already stipulated in the law and that this should be applied accordingly.
Previously, several lawyers believed that the JEM functions as a “political stick”, due to high-profile cases in which they removed prosecutors and magistrates. One of them was the case of the prosecutor Aldo Cantero, who was tried by the Jury, after having charged the Deputy Eusebio Alvarenga, who was a member of the JEM. There is also the case of the prosecutor Ysaac Ferreira, who was removed from office and after a while was reinstated.
