Italian real estate law_inheritance law / mortgage on the parents’ house without permission
Hi there,
it is possible that a child (already deceased) according to Italian real estate law / inheritance law WITHOUT the permission / declaration of consent of the parents (also already deceased) or without a contract between the property / house owner and the mortgage bank / credit institute etc. a mortgage on their inheritance (Children) can take in the mortgage / land charge in the land register / Italian cadastral office by the notary?
Can the remaining remaining heirs (children) sell the house / property in question to an interested buyer (living in Italy) without restrictions under Italian real estate law / inheritance law?
Or can this mortgage, not approved by the parents, of the child who has already died, be offset against this house / property or is this even legally valid under Italian real estate law / inheritance law?
