In the second instance, the defendant is hoping for an acquittal or at least a reduction in the three years and three months imprisonment to which he was sentenced last year. So he let his tenant take control: apparently five-digit amounts were shifted without any control or withdrawn with account authorization, blank receipts were signed that did not contain an exact amount – and attempts were made to defraud the tax office.
Defense attorney Nikolaus Gwosdek now admitted in the proceedings that his client had not supported the seriously ill landlord completely selflessly. After intensive consultation with his two defense lawyers, the policeman confessed that he wanted to “participate” in the assets. However, he did not do so to the extent that he was charged with in the first instance. At least he explained the 42,000 euros that had been found in his locker during the investigation and that came from his landlord.
Drug discovery explained with addiction problem
He justified the fact that drugs had been found in him with an addiction problem that he had had since his time with a task force. However, the defendant sticks to the statement that he took care of the helpless landlord intensively and reduced his working hours by 50 percent. He had officially told his colleagues that he had to look after his sick mother.
The landlord has since died. From him the defendant had received freedom from rent for life and even a right of first refusal to his house for the alleged welfare. “In truth, it was about him, as planned, to snatch all of his assets under the nail, while the victim was getting worse and worse,” it said in 2018 from investigators.
