ZUS on the trail of sick leaves. Here’s how to check what you were doing on L4 [NOWE METODY] 4.10.2021

The amendment to the Act on Social Insurance has given ZUS a new weapon to fight against dishonest sick people. Not only has the office got new opportunities to check what they are doing and where they are on L4, it now also has an unquestionable legal basis to claim sickness benefits. Those who receive high benefits or are on L4 for more than 30 days will be especially under the microscope.

From Saturday, September 18, 2021, an amendment to the Act on the Social Insurance System and certain other acts (Journal of Laws of 2021, item 1621) is in force, which introduced fundamental changes to Art. 84 concerning the reimbursement of unduly collected benefits.
A new point appeared in the amendment, which gives the legal basis for the Social Insurance Institution to request the return of the sickness benefit when it was – according to ZUS – unduly received.

The above-mentioned point is not the only change in the law. At the beginning of 2022, Art. 4 of the amendment to the act on the social insurance system and some other acts. According to it:

In order to determine the right to benefit and its payment, ZUS may obtain data and information to the extent necessary to determine the right to benefits, their amount, calculation basis and their payment from the insured and contribution payers who are obliged to make them available free of charge.
