The Prime Minister, Head of Government, Mr. Ouhoumoudou Mahamadou received, on Friday August 20 at his Cabinet, the President of the High Authority for the Protection of Personal Data (HAPDP), Ms. Sanady Tchimaden Hadatan. The purpose of this meeting, according to Mrs. Hadatan, is to present to the Head of Government the activity report of the HAPDP for the year 2020.
On leaving the hearing, the president of the HAPDP recalled that the law on the protection of personal data requires the HAPDP to provide and transmit to the government, each year, an activity report on the protection of personal data. personal data in Niger.
Ms. Sanady Tchimaden Hadatan recalled that the HAPDP was created in 2017, but did not begin to operate until 2020. “During the launch of its activities in 2020, we had to carry out several actions to raise awareness of the place of data controllers to get them to comply with the HAPDP level, ”she said. “Today, we can say that the HAPDP is fully operational in relation to its activities,” she added. The president of the HAPDP subsequently appealed to all the personalities responsible for data processing to come to the level of the HAPDP to comply with the law. “Any processing of personal data must obtain an authorization from the HAPDP and that for processing prior to HAPDP, the persons responsible for this processing are called upon to come and regularize their situations”, suggested Ms. Sanady Tchimaden Hadatan.
Let us recall that the HAPDP came into being following the adequate normative and institutional framework for the protection of these data set up by the national authorities in 2017. Indeed, through Law n ° 2017-28 of 03 May 2017 relating to the protection of this data. personal data, amended and supplemented by Law No. 2019-71 of December 24, 2019 and its Application Decree No. 2020-309 / PRN / MJ of April 30, 2020, this Institution was born. Thus, this new legal and institutional mechanism allowed the creation and operationalization of the HAPDP as quickly as possible.
The HAPDP is therefore an independent administrative authority responsible for ensuring that the processing of personal data is implemented in accordance with the provisions of the texts in force and international conventions to which Niger has adhered. Finally, it should be noted that the HAPDP ensures that the processing and use of personal data does not infringe public freedoms or pose a threat to the privacy of citizens, in particular in the use of technology. information and communication.
