She is hardly a criminal. Nonetheless, last week, while walking her dogs at Riverside Park on the Upper West Side, Marchand was confronted by two police officers who immediately handcuffed her for lack of identification and for having walked his dogs off leash.
State law prohibits walking your dogs without a leash. While this is certainly a necessary law, given that some dogs are massive and potentially vicious, Marchand’s two mini Australian Shepherds, Comet and Sophie, are hardly of the dangerous type.
According to Marchand, an officer actually used her discretion and told her she was breaking the order and would not be fined but had to leave.
“He was just like, ‘OK, you don’t have a leash. Don’t do it again. ‘ He gave a warning, ”Marchand told the NY Post.
She complied and was leaving the park, when another officer, apparently trying to bolster the state’s declining police statistics, then arrested her once more. She wouldn’t be so lucky this time around.
“And then this other guy ran into a field, I guess that’s like his partner, and he was like, ‘No, no, no, we’re going to have to write to you’,” she said. .
Richard Baron Penman, who was jogging that day, told the West Side Rag that the way the police had treated her was “disturbing.”
“It was disturbing how they treated her like a dangerous criminal pulling her by the handcuffs. It was so unnecessary, ”Penman recalls.
While these “hero” officers tried to figure out what to do with Marchand and his dogs, Marchand was handcuffed for two hours in the park while the officer attempted to force the dogs into a cage.
“It was like he was a man on a power trip. There was no way to calm him down, ”Marchand said. “I was handcuffed for two hours while the police searched for what to do with my dogs as they could not be taken to the police station.”
As the cops humiliated her in front of the other park visitors for two hours, off camera, one of them can be heard explaining how he would willingly use an electric shock stick to get the dogs into the cage.
“He was excited that the rangers had the electric batons or something to shock. He was like, ‘Oh, yeah, they’re going to get them. It will work, ”recalls Marchand.
“I was like, ‘Really, are you excited about this? He said, ‘Yeah, that’s going to work. They won’t like it, but [they’re] gonna go inside and we’re gonna finish it. … I was like, ‘It’s weird that you’re excited about this.’ “
Although Marchand called her boyfriend and asked him to bring his ID card to the park, the officer decided to take him to jail anyway. She was held in a cell for an hour before being released with two citations – one fined $ 200 for failing to comply with officers and $ 100 for having the dogs off leash, he said. she declared.
