The origin of the dispute
The very beginning of the dispute dates back to around 6 p.m. Tuesday, August 3, according to the two people involved. The manager explains “that it’s been four or five days since Damien settled down one meter from the tables on the terrace”, at the level of the Portes d’Or hotel, between his establishment and the Phénix pub, and “that he annoys its customers ”.
At that time, according to Damien, “he [le restaurateur] came to ask me to leave, that he was going to call the police, and he threatened me by telling me that he was going to follow me and hit me, if I stayed there ”.
The manager explains his version: “I already asked him [à 18h environ] if he could leave because it had been annoying customers for a few days. I had had the reflection of a client that day and then I left, because I didn’t want to argue with him ”.
To that, Damien would have explained to him that he “was in front of a hotel” and “that in a pinch, the lady of the hotel could ask him to leave but not him”, insisting that he was “in the legality. “. Both agree on the fact that the manager “leaves the restaurant” after the exchange.
Early evening
“I come back 3/4 hours later”, details Damien. He explains that he is positioned “in the same place as usual”, waiting “for a pasta dish paid for by a client of the restaurant opposite. [le Capri] ».
Around 9:30 p.m., the manager’s wife would, according to the owner of Entrecôte Stanislas, “allée le [Damien] see to tell him gently to leave after he asks for a cigarette at a girls’ table, next to the place where Damien usually settles. In particular because the girls would have indicated “that they wanted to finish the dish inside”, following the passage of Damien.
The moment of altercation
Still according to the restaurateur, Damien’s dog would then have bitten his wife, which provokes his reaction.
He specifies: “At that moment I said to him, ‘Oh! What are you doing? It’s good, go! The dog attacks people, you scare customers away, you insult us, it’s not good. And there he said to me, “Go fuck your ***,” who is dead. I twisted. I had the glass in my hand, I broke it on the ground. […] I took a second glass and broke it there ”.
