The anti-smoking law was declared constitutional on Wednesday by CCR, after discussing the complaint filed by 33 senators, who argued that by defining closed public space, the law introduces a form of discrimination.
Now that the law has been enacted, enters into force 45 days after its publication in the Official Gazette.
Where smoking is prohibited
According to the new law, smoking is prohibited in “any space accessible to the public or intended for collective use, regardless of the form of property or the right of access, which has a roof, ceiling or ceiling and which is delimited by at least two walls, regardless of nature or of a temporary or permanent nature “.

The anti-smoking law also prohibits smoking in workplaces and in any children’s playground, whether indoors or outdoors.

The interdiction is also applied in the means of public transport, in the sanitary and educational units, as well as those destined for the protection and assistance of the child, state and private.
The exception is the cells for detainees in the maximum security penitentiaries. At the same time, smoking is allowed in specially arranged rooms, exclusively in the transit area of international airports, respecting the following conditions: not to be a passage or access space in closed public spaces, to be equipped with functional ventilation systems to ensure the elimination tobacco smoke, with negative pressure, to be equipped with ashtrays and fire extinguishers and arranged in accordance with the legal provisions in force regarding the prevention and extinguishing of fires and to be marked in a visible place with signs: “Smoking room”, “Smoking place” .
The law also prohibits the sale of tobacco products in health and education units, state and private, as well as the sale of cigarettes, cigarettes and cigarillos.
What fines do those who do not respect the law risk
Failure to comply with the provisions of the anti-smoking law by individuals is sanctioned with a contravention fine from 100 lei to 500 lei.
The non-observance by the legal persons of the provisions of the law is sanctioned with a contraventional fine of 5,000 lei at the first violation, with a contraventional fine of 10,000 lei and with the complementary sanction of suspension of the activity until the remedy of the situation that led to the suspension of the activity, to the second deviation.
Committing a new contravention provided by the anti-smoking law is sanctioned with a contravention fine of 15,000 lei and with the complementary sanction of closing the unit.
At present, 17 of the 28 states of the European Union totally ban smoking in enclosed public spaces, in public transport and at work.
