Judge Richard Meredith pointed out last week that the management of the Outaouais Integrated Health and Social Services Center (CISSSO) did not call the police and “paid no attention” to the protocol which requires that the Center for assistance and the fight against sexual assault (CALAS) be contacted immediately.
It was the victim and her father who finally alerted the police a week after the incident, while the management of the CISSSO had handled the case as a matter of human resources.
Convicted of sexual assault on July 13, Martial Yanon explained during his trial that he wanted to help his team by performing an examination on the rectum and groin of the patient, who was experiencing intense pain at this time. region.
However, his auxiliary status did not allow this employee with 17 years of experience to perform such palpations. The victim said he was shot in the vagina and rectum while hearing comments of a sexual nature.

The facts occurred around 4:30 am, on the night of November 17 to 18, 2019. When the new team was relieved, around 7:30 am, nothing in the patient’s file indicated that the nursing assistant had carried out the alleged examination, three hours earlier.
Defendant himself confirmed at trial that he did not write that he palpated the patient.
“Didn’t you write it down?” Asked the judge.
“No,” replied the accused, who added that despite everything he wrote other notes before continuing his shift.
The nursing assistant who took over was called to testify at the trial. She explained to the judge that the confused patient wanted to talk to her early in the day. The bedridden woman wanted to make sure that she “hadn’t been dreaming” when she saw a man enter her room to perform the so-called exam. The nursing assistant who arrived in relief confirmed to him that Mr. Yanon had indeed been able to access his room at this time of day.
“Madame said that the man had spoken of her ‘beautiful vagina’, she explained. At the start of our shifts (around 7:30 am), we have the reports with the relevant data. […] I read it after the lady complained, just to see if it was mentioned (the rectal check), then to see if it was indeed that. “
The magistrate made sure to clarify this part of the story. “Did that confirm that there had been a digital rectal examination on his part?”
“To my memory, I did not see any,” replied the witness.
The Outaouais Healthcare Professionals Union declined to comment on the matter following the publication of our report on Wednesday.
The minister responsible for the Outaouais, Mathieu Lacombe, was not available due to the summer vacation.
