Guillaume Kasbarian, deputy for the first constituency of Eure-et-Loir, Chartres, is behind a simplified procedure for the “express” eviction of residential squatters.
With the ASAP law, promulgated on December 7, 2020, victims now have the possibility of repossessing their home in a few days.
The report on the application of this law, produced by the member for Chartres and Sylvia Pinel, also a member of Parliament, was issued Tuesday, July 13, 2021.
Six months later, the figures demonstrate the effectiveness of the device. Since January, 124 procedural requests have been filed with the prefectural services. Of these requests, 95 were successfully processed.
A large number of procedures in Paris
The parliamentarian welcomes in particular the prefecture of Paris, which carried out twenty-three evacuations, out of a total of thirty-three requests, “allowing six tenants and seventeen owners to find their home urgently”.
If the situation is noticed in Paris, there is still a disparity between the regions, no procedure has been requested in Corsica, in the Grand-Est et en Normandie.
Properly inform victims
For the Center-Val de Loire Region, only one procedure has been initiated. According to Guillaume Kasbarian, communication work with victims remains to be done:
When you are a victim of squatters, whether or not it is your main residence, you file a complaint, prove that it is indeed your home, have the occupation noted by a judicial police officer and we seized the prefect to request an evacuation.
And also to fight against false information: “no, the winter truce does not apply to squatters”, assures the elected official. The eviction procedure can also be adapted to main or secondary residences and victims can file a complaint within an unlimited period of time from the discovery of the squat.
