A secret audio recording that the victim (30) made of the last conversation with her former boyfriend convinced the court in Utrecht that K. killed his ex with premeditation.
The relationship between the 30-year-old victim and the Utrecht resident failed at the beginning of last year. After a month of radio silence, K. contacted again on June 12, 2020 to handle certain matters such as outstanding fines and to pick up his things. That app was not answered by the woman.
A day later, he waited unannounced for the woman at her home in the De Meern district. When his ex came home late in the evening, the two went in for a chat.
Conversation secretly recorded
The victim secretly recorded that conversation on her cell phone. In the 117-minute recording, after 20 minutes, K. could be heard telling the woman that he had previously sat on her sidewalk with a loaded gun. “I’ve got nothing to lose, I’ll shoot you right through the cracks,” said K.
After almost two hours, the woman wanted to stop the conversation and walked away, whereupon K. grabbed a firearm and pointed it at her. “Do normal David,” were the victim’s last words, after which the first shot sounded and K. loaded the gun and fired again. He then shot the woman several times in the head at close range “out of mercy”.
“A few weeks before the shooting, the man had planned to kill the victim,” the court ruled as to why there was murder and not manslaughter, as the lawyer had argued. “From the fact that he deliberately took a loaded firearm with him on June 13 and only fired after she rejected him by ending the conversation, the court infers that he has still carried out his earlier intention.”
