Loophole for the Stötzel vote

The Marburg lawyer Peter Hauck-Scholz, who, together with his colleague Reinhard Karasek, filed a lawsuit against the validity of the Mayoral election of March before the Administrative Court of Giessen, has shown a perspective with which the crisis of the targeted left-wing alliance in the Marburg parliament could be ended.

In a video conference, the lawyer with a focus on administrative law stated that he wanted to draw attention to the fact that the current electoral law could not be implemented in times of pandemic. However, he could imagine withdrawing his lawsuit if the city parliament takes an initiative to reform the local electoral law in order to re-regulate the validity of elections even in times of force majeure – such as the corona pandemic.

This declaration could be the loophole for further negotiations on a left alliance. The lawsuit had led to a heated dispute between the SPD and the Greens, who want to vote out Mayor Wieland Stötzel (CDU) as a first step this afternoon.

The SPD had made the withdrawal of the lawsuit a condition for the joint deselection of the mayor and further negotiations for a left-wing alliance. Whether the lawyer’s declaration is sufficient for a truce is decided by the bodies of the SPD and the Greens in front of parliament. CDU parliamentary group leader Jens Seipp spoke in an initial reaction of an attempt at blackmail against parliament, which was “unobjectionable” against elected parliamentarians.
