The first chamber of the Dakar Commercial Court cleared, last Wednesday, the dispute between the Agricultural Bank (formerly Cncas) and the company Boyges solutions systems limited. The structure of Bougane Guèye Dany was ordered to pay the bank the sum of 611,489,959 Fcfa, in addition to that of 14,720,857.4 Fcfa for penalties of 10% “provided for in article 13 of the act. pledge of September 5, 2014, without prejudice to accrued or accrued interest ”, according to the decision. Boyges will also have to pay 5,000,000 CFA francs to the Agricultural Bank as damages for abusive resistance and 3,000,000 CFA francs for irrecoverable costs.
In addition, the court indicates that Bougane Guèye Dany will be held jointly and severally liable for the payment of said sum up to the amount of 590,346,984 CFA francs in principal.
Finally, the judges validated the conservatory mortgage registered on the building covered by TF 19.652 / GR located in Dakar Sicap Cité Keur Gorgui, lot n ° R130, belonging to Bougane Guèye Dany; this, up to the sum of 611,489,959 Fcfa.
