“Your fight is undoubtedly legitimate, but you are not taking it to the right ground. »The public prosecutor of Caen (Calvados), Jean-Pierre Triaulaire, did not hide that Chi Minh Pham’s action before the criminal court had little chance of success. This 56-year-old man is the founder of the start-up YouTime. “It is an appointment management platform for dependent elderly people at home, who benefit from social assistance paid by the departments”, he explains, Tuesday, July 6, 2021, at the bar of the court. “40% of unrealized aid”
According to him, the Department of Calvados could have, even should have, opened the organization of this public service to competition, and thus allow his company to offer its services. For the supposed loss of turnover, he claims 100,000 € in damages, “per month, since January 2016 (date of creation of YouTime)”. Or € 5.4 million.
In front of circumspect judges, the man details his reasoning:
The Department embezzles social assistance money to finance SAAD (Home Help Services). Allowances are not paid to beneficiaries, but to these services. However, these only achieve on average 60% of the planned aid!
Underpaid carers, inappropriate interveners, even absent and not replaced: the president of YouTime denounces a system “shocking, to the detriment of the beneficiaries”. “No monthly assessment is made to recover the undue payments from the SAADs. On 100 € of social assistance, 40% are not carried out, and on the 60 remaining, half is used to pay the administrators. In the end, only 30 € are really used for the beneficiaries ”.
“The Department applies the texts”
For the lawyer of the Departmental Council of Calvados, Mr.e David Gorand, Chi Minh Pham’s request is inadmissible:
The Department only applies the texts. Beneficiaries can freely choose their provider, including an independent person, and the rates are set by law!
The president of the tribunal, Bénédicte Delgove, seeks to understand where the business manager is going. “You are not a direct victim since you were never chosen as a provider,” she points out. No text obliges a Department to open a public market for the management of this social assistance ”.
The court will deliver its decision on Wednesday, September 8.
