SANTO DOMINGO.- The lawyers of the Madre Tierra Peasant Association demanded from the Attorney General’s Office the immediate deliveries of the goods and assets illegally occupied to said entity since this is a legally constituted institution and that is outside the coral case.
The lawyers Francisco Álvarez, Cristian Martínez, Romer Jiménez and Elsa Trinidad affirmed that as is known throughout the national territory and far beyond its borders, Mother Earth has been the subject of a frenzied and illegal media campaign developed by the Public Ministry with the purpose of discrediting it.
They stated that the facilities of the legal entity, Asociación Campesina Madre Tierra, as well as its corporate control, have been usurped and occupied by people whose only information that “we have for identification is precisely that they are accredited as members and representatives of this Office of the Attorney General of the Republic ”.
They said that they cannot affirm that said persons are members of the Attorney General’s Office as evidenced by their badges. “We do not have any legal endorsement that allows such an affirmation, but it allows us to broaden the possibilities that what happens is another humiliation carried out by the authority outside the law.
They argued that outside of the understanding that legal persons exist, that they have rights and that the national and international legal framework that supports this indisputable reality cannot be ignored by the Dominican State itself.
They added that in the meantime, these people de facto spend the night and control the legal entity itself, its properties, operations and money … even what they obtain from the sale of part of their assets without granting receipts.
They meant that this illegal situation has brought with it the loss of millions of pesos, since the ordinary operations of the Madre Tierra Peasant Association have been irreparably affected and difficult to quantitatively frame by the indicated practice of negotiating assets of the entity.
They denounced that it is receiving cash without appearing in the official records established by law and without having the necessary and reliable controls to subsequently audit these financial transactions of individuals.
They also asked the MP to have an exhaustive investigation into the way in which said entity has been administered since it was kidnapped in clear violation of national laws.
They specified that Mother Earth has had to discover alarming realities around the denounced event that undoubtedly justify the realization of serious investigations and categorical results in this regard.
They revealed that the same Office of the Attorney General of the Republic prevented the Association from being represented by a lawyer who, with the haste of misinformation, tried to represent him at the hearing from whose bench he was forced to descend.
They affirmed that the Madre Tierra Peasant Association is the one who the Attorney General’s Office prevented even a lawyer from representing him. It overlooked that the only way this could happen was if, prior to the start of said process, the same authority withdrew from the instance.
They pointed out that it is not as someone proposed: that it was necessary to wait for the Attorney General’s Office to conclude to define whether or not the presence of an accused by her merited her defense by the Ministry of Lawyers.
They expressed that while they did not allow him to defend himself as a legal person, in front of the extended audience made up of national and international television audiences, the Attorney General’s Office unleashed all kinds of false accusations on Mother Earth in one of the most humiliating processes and handling of the authority in our judicial history. .
