Naturopaths are only allowed to take their own blood within narrow limits – healing practice

Autologous blood products from naturopaths must be produced using a recognized homeopathic manufacturing process. Because without such a recognized preparation method, naturopaths are not allowed to take their own blood from patients, ruled on Friday, April 23, 2021, the Higher Administrative Court (OVG) North Rhine-Westphalia (Az .: 9 A 4073/18, 9 A 4108/18 and 9 A 4109 / 18). According to the legal provisions, the removal of blood donations is generally only reserved for doctors or is permitted under the responsibility of a doctor, according to the Münster judges. This also applies to an autologous blood donation.

In the specific cases, the Münster district government had forbidden homeopaths from Borken, Nordwalde and Senden to take autologous blood from their patients for autologous blood therapy that is widely used by alternative practitioners. As part of the therapy, the naturopaths had taken a small amount of blood from the respective patient in order to enrich it with an oxygen-ozone mixture or with homeopathic finished medicinal products. Then the blood was injected back again.

The district government prohibited the blood collection. Rather, the patient must consult a doctor for these purposes.

OVG Münster: autologous blood products only after homeopathic procedures

The OVG confirmed the district government’s decision. According to the Transfusion Act, blood donations may only be taken by doctors or under the responsibility of a doctor. This applies not only to foreign blood, but also to autologous blood. According to a statutory exception regulation, alternative practitioners are also allowed to take blood for the production of homeopathic autologous blood products. But this exception does not apply here.
Because not every autologous blood product made by a naturopath is homeopathic. Rather, it must be produced according to a recognized homeopathic preparation process, which is described in the European Pharmacopoeia or in one of the officially used official pharmacopoeias of the EU member states. In the disputes, however, neither the blood itself nor the autologous blood preparation would be subjected to a homeopathic technique.

The OVG has not decided on the effectiveness of autologous blood therapies or whether alternative practitioners need a manufacturing license for autologous blood products in accordance with the Medicines Act.
