Due to the fourth civil protection law (“Bundesnotbremse”), the twelfth Bavarian Infection Protection Ordinance will be adapted in certain areas. The Bavarian Ministry of Health pointed this out on Friday (April 23) in Munich. With its guiding principle of caution and prudence, Bavaria had already implemented many of these new federal regulations of the Civil Protection Act before this law came into force. As of today, other federal states must also follow this consistent course in the fight against the pandemic. Bavaria is now sticking to some stricter rules.
The situation remains serious. Intensive care physicians from all over Germany are already warning of overloaded intensive care units and postponed operations. The medical staff works physically and mentally to the limit. The number of infections is increasing.
The nationwide regulations that are now in force are intended to make infection protection measures more comprehensible for all citizens and to further increase acceptance of crisis management. In terms of content, there are only a few areas of adjustment for the Bavarian population in the Twelfth Bavarian Infection Protection Measures Ordinance (12th BayIfSMV).
A 7-day incidence above 100 now applies across the country as a binding minimum standard for infection protection measures. This means, among other things, that
– For open retail and service businesses with an incidence of 100 or more, an adjusted number of customers applies. A maximum of one customer per 20 square meters for the first 800 square meters and an additional customer per 40 square meters for the additional sales area can now be in the shop at the same time.
– for shops that do not belong to the shops for daily needs expressly named in Section 12 (1) sentence 2 of the 12th BayIfSMV, only up to a 7-day incidence of up to 150 customers after an appointment has been made if they can also show a negative test result (no more than 24 hours past PCR test, rapid antigen test or self-test under supervision) (“Click & Meet”).
– From a 7-day incidence of 100, the use of hairdressing services and foot care is only permitted for customers if they have a negative test result (no more than 24 hours ago PCR test, rapid antigen test or self-test under supervision) can. In addition, there is an FFP2 mask requirement for staff.
– Mutual free childcare in permanent childcare communities is no longer possible regardless of the number of households involved.
– In the area of culture, the previously applicable regulations remain in place and the schools, with the exception of the final classes, remain closed if the 7-day incidence exceeds 100.
The Bavarian regulations on night curfews have also remained the same. Only the well-known, justified exceptional cases still apply here. In contrast to the federal emergency brake, exercise in the fresh air between 10 p.m. and midnight is not an exception to the curfew in Bavaria.
The aim of the nightly curfew is to reduce contacts and restrict mobility. This is very important to prevent further infections as much as possible. That is why Bavaria is sticking to the stricter regulation for the time from 10 p.m.
The Bavarian infection control measures were quickly adapted to federal law where it was necessary. The upcoming Council of Ministers will discuss whether further adjustments are necessary.
